CRIMINAL CASES
Criminal cases are either misdemeanors or felonies.

MISDEMEANORS
The most serious misdemeanors are punishable by a maximum term of
imprisonment of 364 days in jail and a $2500 fine.  Misdemeanors can be anything
from battery (punching your neighbor, etc.) to first time DUIs to everything in between.  
Misdemeanor charges are denoted by the letters "CM" in the case number.

FELONIES
Felonies are serious business.  Felonies range in classification from Class 4 (least
serious) to Class X (most serious).  The punishment for felonies can vary greatly, but
can range from probation to thirty years (or more) in prison.  Felony charges are
denoted by the letters "CF" in the case number.

TRAFFIC OFFENSE AND ORDINANCE VIOLATIONS
These don't sound all that serious.  The prosecutor in court may tell you it's no big deal
since it is a traffic offense, but the prosecutor has no duty to tell you about the
consequences of your guilty plea such as:






It is always best to have an attorney represent in court no matter how trivial the offense
may seem since the Secretary of State rules are unknown to many drivers and are
often modified without the public's knowledge.  

TICKETS FOR DRIVERS UNDER 21

Most driver's education courses do NOT tell teenagers the consequences of tickets
when you are under the age of 21.  Most people are aware that drivers can obtain three
traffic tickets in one year before the Secretary of State will suspend driving privileges.  
HOWEVER, drivers under 21 can only have two traffic violations in a 24-month period.  
This means that anyone under 21 must obtain an attorney to ensure his/her driving
privileges remain intact.

TICKETS FOR DRIVERS UNDER 18

Aside from the two traffic tickets in a 24-month period, a minor must have a parent
present with him/her in court.  Anyone under the age of 18 cannot legally consent to any
court proceedings but must have a parent consent on his/her behalf.  Again it is best to
have a lawyer assist the minor to assure retention of the minor's driving privileges.



SMALL CLAIMS

Any civil action for money under $10,000 is a small claims case.  Small Claims cases
can cover anything from a landlord tenant dispute to a car accident.  



FAMILY LAW

In Illinois, we call divorce Dissolution of Marriage.  On one hand, people that have
made the decision to end their marriage want it to be over, and simply don't want to
think about it anymore (this is natural, divorce is emotionally difficult.)  On the other
hand, parties to a divorce must make sure they protect their rights to their property and
to have custody of or to maintain visitation with their children.
