FIRST COURT DATE
IN TRAFFIC OR CRIMINAL CASE

WHAT ACTUALLY HAPPENS WHEN YOU GO TO COURT

Your first court date is simply for PRESENTMENT and perhaps ARRAIGNMENT.

On this first court date, the Judge will read you the charges against you and the
possible penalties.  Many times, a reading of your rights and possibly penalties
is waived a reading of your rights and the possible penalties because Attorney
Logan will have already explained them to you.

On your first appearance date, Attorney
John A. Logan  will file the following
documents:

  •        ENTRY of APPEARANCE
  •        MOTION FOR DISCOVERY
  •        other documents as dictated by the circumstances of your case

The Entry of Appearance allows the Court to know who your lawyer is and that
you a pleading not guilty.  The Motion for Discovery requests all the relevant
documents (police reports, audio and video recordings, photographs, etc.) that
will prove your innocence.

You will probably not even have to speak, so don’t be nervous.
Attorney Logan
will speak to the Assistant State’s Attorney who is handling your case and set
the next court date.  The State's Attorney needs time to gather all of the relevant
documents that were requested in the Motion for Discovery.

This is an attempt to explain actually happens when you go to court in everyday
terms.  If you have any questions, please don’t hesitate to call Attorney
John A.
Logan at 815 316-2920.
